1. Acceptance of Terms

By accessing, downloading, installing, or using AimShield ("the Service", "the Software", "our Product"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any part of these terms, you are expressly prohibited from using the Service and must discontinue use immediately.

2. Definitions

• "Service" means the AimShield anti-cheat detection software and related services
• "User" means any individual or entity that accesses or uses the Service
• "Content" means all data, information, and materials provided through the Service
• "Server" means FiveM game servers where the Service is installed
• "We", "Us", "Our" refers to AimShield and its operators

3. Service Description and Scope

AimShield is an anti-cheat detection system designed exclusively for FiveM servers. The Service detects various forms of cheating software including but not limited to aimbot, silent aim, magic bullet, aim assistance, and other unauthorized modifications. The Service operates through automated detection algorithms and may include manual review processes.

4. User Eligibility and Account Requirements

To use the Service, you must:

• Be at least 18 years of age or have parental/guardian consent
• Have the legal capacity to enter into binding agreements
• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your account credentials
• Be the legitimate owner or authorized administrator of the FiveM server
• Comply with all applicable laws in your jurisdiction

5. Prohibited Uses and Conduct

You expressly agree NOT to:

• Reverse engineer, decompile, disassemble, or attempt to derive source code from the Software
• Modify, adapt, alter, translate, or create derivative works of the Software
• Remove, alter, or obscure any proprietary notices, labels, or marks
• Use the Service for any illegal, unauthorized, or malicious purposes
• Attempt to bypass, disable, or circumvent any security features
• Share, distribute, sell, lease, or sublicense your account or the Software
• Use the Service to violate any third-party rights
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to access the Service without authorization
• Engage in any activity that could damage our reputation or business

6. Intellectual Property Rights

The Service, including all software, algorithms, designs, text, graphics, logos, and other content, is the exclusive property of AimShield and is protected by copyright, trademark, trade secret, and other intellectual property laws. All rights not expressly granted are reserved.

You acknowledge that no title to or ownership of the Software is transferred to you. Any unauthorized use of our intellectual property may result in immediate termination and legal action.

7. Limited Software License

Subject to strict compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Software solely for its intended purpose on your authorized FiveM server. This license is personal to you and may not be assigned or transferred.

This license automatically terminates upon any breach of these Terms or upon termination of your account.

8. Payment Terms and Billing

• Payment Required: All fees must be paid in advance before service activation
• Billing Accuracy: You warrant that all payment information is accurate and current
• Authorization: You authorize us to charge your payment method for all applicable fees
• Price Changes: We reserve the right to modify pricing with 30 days written notice
• Failed Payments: Service may be immediately suspended for payment failures
• Taxes: You are solely responsible for all applicable taxes and fees
• Currency: All prices are in Euros (EUR) unless otherwise specified

9. No Refund Policy

ALL SALES ARE FINAL. Due to the digital nature of our Service and immediate access upon purchase, we do not offer refunds, returns, exchanges, or credits under any circumstances, including but not limited to:

• Change of mind or buyer's remorse
• Technical difficulties on your end
• Incompatibility with your server setup
• Dissatisfaction with detection results
• Account termination for Terms violations
• Service discontinuation

By purchasing our Service, you explicitly waive any right to refunds or chargebacks.

10. Service Availability and Performance

While we strive for optimal performance, we make no guarantees regarding:

• Continuous, uninterrupted, or error-free operation
• Compatibility with all server configurations
• Detection accuracy or effectiveness
• Response times or performance metrics
• Availability during maintenance, updates, or emergencies

We reserve the right to modify, suspend, or discontinue the Service at any time without notice or liability.

11. Data Collection and Privacy

Our data collection and processing practices are governed by our Privacy Policy, which is incorporated by reference. By using the Service, you consent to all data practices described in our Privacy Policy.

12. Account Termination

We may immediately terminate or suspend your account and access without prior notice for any reason, including:

• Violation of these Terms
• Suspected fraudulent activity
• Non-payment of fees
• Abuse of the Service
• Legal or regulatory requirements
• At our sole discretion

Upon termination, all rights and licenses granted to you will immediately cease, and you must discontinue all use of the Service.

13. Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We expressly disclaim all warranties, whether express, implied, or statutory, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or completeness
• Warranties that the Service will meet your requirements
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the results obtained from use of the Service

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AIMSHIELD, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access to or alteration of your data
• Damages resulting from any conduct or content of third parties
• Damages resulting from interruption, suspension, or termination of the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to defend, indemnify, and hold harmless AimShield and its owners, operators, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorney's fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit or transmit through the Service
• Your negligent or wrongful conduct

16. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet failures, or other force majeure events.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Belgium.

You hereby consent to the personal jurisdiction of such courts and waive any objection to venue.

18. Dispute Resolution

Any disputes must first be addressed through good faith negotiations. If resolution cannot be reached within 30 days, disputes shall be resolved through binding arbitration in Belgium under Belgian arbitration rules. The arbitrator's decision shall be final and binding.

19. Modifications to Terms

We reserve the right to modify these Terms at any time at our sole discretion. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of any modifications. It is your responsibility to review these Terms regularly.

20. Severability and Waiver

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AimShield and supersede all prior agreements, understandings, and communications, whether written or oral.

22. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice or consent.

23. Survival

The following sections shall survive termination of these Terms: Intellectual Property Rights, Payment Terms, No Refund Policy, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.
